Nortel Settles Patent-Infringement Lawsuits With Ciena

08/08/2006

Nortel Networks Ltd. has settled two lawsuits with Ciena Corp. after alleging the maker of optical networking equipment infringed on its patents.

A Nortel spokesman on Tuesday could not comment on which patents Nortel said Ciena wrongly used or the amount of the settlement. “The details are confidential,” said Jay Barta.

Documents were not immediately available from the court system.

In a press release, Nortel did say it had made a long-term patent cross-license agreement with Ciena as part of the settlement.

Nortel filed suit against Ciena – in January 2005 and again in April 2006 – in the U.S. District Court for the Eastern District of Texas, a court known for handling patent litigation. Companies that are not located in the eastern district are allowed to file suit there. Some entities are pressing Congress to change the law to require businesses that file suit to have a presence in that district.
